This data protection declaration clarifies the type, scope and purpose of the processing of personal data (hereinafter referred to as "data") in the context of the provision of our services as well as within our online offer and the associated websites, functions and content as well as external online presences, such as open our social media profile (hereinafter collectively referred to as "online offer"). With regard to the terminology used, such as "processing" or "person responsible", we refer to the definitions in Art. 4 of the General Data Protection Regulation (GDPR).

The protection of your personal data is very important to us, Joseph II. Gourmet GmbH, Annagasse 3/8, A-1010 Vienna ("JOSEPH II.", "We", "us"). Of course, we will not forward your inquiry to third parties without your consent, unless it concerns inquiries regarding orders that concern a third party (e.g., our fulfillment service provider).

3.2. Advertising contact

With your voluntary consent to be contacted by us for advertising purposes, we will process your E-mail address, title and your name for sending direct marketing materials in accordance with Section 107 of the Telecommunications Act (TKG) to the extent agreed in each case: JOSEPH II. News to keep you informed about our offers, special promotions, and new product launches, as well as exciting topics from the world of wine and spirits; JOSEPH II. Events about culinary and cultural offerings from the world of wine and spirits. If you have also given your consent to the use of marketing and analysis cookies, your consent to receive newsletters also includes the information collected in this way about your customer behavior, which we use to personalize these advertising mailings.

You may revoke your consent to receive promotional contact at any time, without giving reasons, for all or individual purposes, and with future effect (e.g., via a link at the end of each newsletter or via our unsubscribe link on the website). If you forward our newsletters to third parties, you are obligated to comply with the legal provisions and obtain the recipient's prior consent. If a third party asserts claims against us due to your forwarding of a newsletter, you will indemnify and hold us harmless from all related claims, including penalties and legal defense costs.

3.3. Promotions

In connection with competitions offered by us, your data will only be used to process the competition, unless you give us your express consent to use it for other purposes.

3.4. Transmission to third parties

We also transmit your personal data to external vicarious agents or service providers to the extent necessary: to IT service providers and/or providers of data hosting or data processing or similar services; to other service providers, providers of tools and software solutions who also support us in providing our services and act on our behalf (including providers of marketing tools, marketing agencies, communications service providers and call centers); to any third parties who are involved in fulfilling our obligations to you (such as fulfillment service providers, in particular the KASTNER GROUP, parcel service providers for the delivery of your web shop order to you, payment service providers for payment processing in the web shop, banks for payment processing); to other external third parties to the extent necessary (e.g. auditors, insurance companies in the event of an insurance claim, legal representatives in the event of an incident, debt collection agencies in the event of late payment or non-payment, etc.); to authorities and other public bodies to the extent required by law (e.g. tax authorities, etc.); to service providers (e.g., KSV 1870) for credit checks when purchasing through our online shop or applying for a membership card with a payment function based on our legitimate interests. Our legitimate interests exist due to the associated economic risk that you may not be able to pay the invoiced amounts in these cases. In these cases, your fundamental rights and freedoms do not override them.

4. Storage period

We generally only store your personal data for as long as it is necessary to fulfill our obligations to you. However, due to our retention obligations under tax and corporate law, we generally store your personal data provided in connection with orders for seven years after the contract has been fulfilled.

We store the personal data you provide as part of your inquiries for a period of six months after we have answered your inquiry so that we can respond to any follow-up questions. If you have only registered for newsletters and promotional information and are not a customer of ours, we will store your personal data until you revoke your consent and for a maximum of three years from your last contact.

5. Data backup

We generally only store your personal data for as long as it is necessary to fulfill our obligations to you. Furthermore, you can revoke consent you have given at any time, with future effect, without giving reasons.

Furthermore, you have the right to object to data processing if the processing serves direct marketing purposes. If we process your data for legitimate purposes, you also have the right to object at any time if there are reasons related to your particular situation. You have the right to lodge a complaint with a data protection supervisory authority. The data protection supervisory authority responsible for us is:
